Delhi High Court Grants Interim Injunction Against T-Series, Safeguarding the Aashiqui Film Franchise
The Delhi High Court has issued an interim injunction preventing T-Series (Super Cassettes Industries Ltd) from using the titles Tu Hi Aashiqui, Tu Hi Aashiqui Hai, or any other name incorporating the term “Aashiqui” for their upcoming film starring Kartik Aryan and directed by Anurag Basu. This ruling comes in response to a lawsuit filed by Vishesh Films, the co-producers of the original Aashiqui films, aimed at protecting the integrity of the established film series. Justice Sanjeev Narula, who presided over the case, emphasized that the title “Aashiqui” is not just a standalone term but has become synonymous with a recognized film franchise.
The court acknowledged the significant brand value of the Aashiqui series, which includes two successful installments released in 1990 and 2013. The injunction was granted to prevent T-Series from causing public confusion by using a title that closely resembles the established franchise. The court noted that there is a potential for confusion, especially given the overlap in production teams and the media narratives suggesting that T-Series’ proposed film could be perceived as part of the Aashiqui franchise. This confusion, even if temporary, could dilute the brand and undermine the distinctiveness of the Aashiqui series.
In his ruling, Justice Narula stated, “Trademark law is concerned with the initial likelihood of confusion, where the public might be misled into believing that there is an association between the T-Series film and the well-established Aashiqui franchise.” Vishesh Bhatt, Managing Director of Vishesh Films, expressed satisfaction with the court’s decision, stating that it protects their beloved franchise and reinforces their commitment to nurturing their intellectual properties.The court’s decision underscores the importance of safeguarding titles that have become integral to a film series, ensuring that their distinctiveness and recognition are maintained over time.
