Priya Kapur’s ‘Position Swap’ Defence Suffers Major Blow in Sunjay Kapur Will Case: Court Flags Power Grab, Missing Attachment, and “Suspicious Suppression”

The legal battle over the late industrialist Sunjay Kapur’s Will has drawn intense attention due to its impact on his children with actress Karisma Kapoor, Samaira and Kiaan. The dispute has escalated in the Delhi High Court, where fresh arguments have cast serious doubts on Priya Kapur’s defence. Senior advocate Mahesh Jethmalani, representing Samaira and Kiaan, challenged Priya Kapur’s long-held claim that her 2023 exit from Automotive India Pvt Ltd (AIPL) was a consensual “position swap” with Sunjay. Instead, he argued that her removal on May 31, 2023, stemmed from marital discord. Corporate records, he pointed out, show that Priya neither became Managing Director of Raghuvanshi Investment Pvt Ltd (RIPL) nor held any official role there.
Priya was never made the MD of RIPL… She was removed from AIPL,” Jethmalani stated, undermining her narrative of a smooth corporate transition and harmonious family relations—especially relevant given her repeated claims of cordial ties with Karisma Kapoor’s children. Following Sunjay’s death in June 2023, the timeline of Priya’s corporate appointments has come under scrutiny. Court documents reveal she was appointed director of AIPL just one day after his passing and reinstated herself as Managing Director within a week. Jethmalani argued this reflected opportunism rather than continuity: “She was not in control when Sunjay was alive. She sought control only after his passing.”
This corporate timeline coincides suspiciously with the sudden emergence of a contested Will, critical to determining the legal rights of Sunjay’s heirs, including Karisma’s children. Further complicating the case is the conduct of the named executor, Shradha Suri Marwah, who reportedly failed to pursue probate or manage Sunjay’s assets as required. Jethmalani emphasized that an executor cannot selectively enforce parts of a Will. The court was also informed that Shradha claimed to have “deleted” a crucial email attachment containing the alleged Will, even though the email itself was produced as evidence.
You cannot delete the attachment without deleting the email,” Jethmalani argued, calling it an “impossible explanation” and highlighting the suspicious disappearance of a key document that appeared in an earlier email but not in the final version.The case is scheduled for further hearing on December 22, where the court will continue to examine inconsistencies around Priya’s corporate role, her actions after Sunjay’s death, and the missing Will attachment—issues central to the dispute that could profoundly affect the future of Sunjay Kapur’s children, legacy, and businesses.
