CCPD Sends Notice to ‘Aankh Micholi’ Producers and CBFC Over Alleged Mockery of Disabilities in Film’s Content

The Court of the Chief Commissioner for Persons with Disabilities (CCPD) has issued notices to the producers of the Hindi film “Aankh Micholi” and the Central Board of Film Certification (CBFC) requesting a response to allegations that the film’s content mocks various types of disabilities. According to a Times of India report, Deputy Chief Commissioner (Disabilities) PP Ambashta issued a notice on November 11, 2023, to the directors of the companies involved in the production of the film “Aankh Micholi”. The notice also seeks a response from the CEO of the CBFC and the secretary of the Ministry of Information and Broadcasting.

The CCPD’s notice acknowledges that the film’s content appears to ridicule disabilities specifically mentioned in the Rights of Persons with Disabilities Act, 2016, including speech and language impairments, hearing impairments, visual impairments, and intellectual disabilities. The notice emphasizes that the RPwD Act criminalizes intentional acts of insult or intimidation with the intent to humiliate a person with a disability in any public space.

The CCPD has directed the filmmakers and the approving authorities to investigate the matter and provide their responses along with any corrective measures taken within 10 days of receiving the notice. It has also issued a warning that compliance is mandatory, as failure to provide any information requested under the RPwD Act is a punishable offense.

The CCPD’s notice follows concerns expressed by disability rights organizations regarding the content of the comedy film “Aankh Micholi”, released on November 4, 2023. These groups have raised objections to the film’s portrayal of disabilities, which they believe trivializes significant impairments and reinforces harmful stereotypes.

The CCPD has directed the filmmakers and the approving authorities to conduct a thorough investigation into the matter and submit their responses along with any corrective actions taken within 10 days of receiving the notice. The CCPD has also issued a stern warning that compliance is mandatory, as failure to provide any information requested under the RPwD Act constitutes a punishable offense.
