Delhi High Court Grants Interim Relief to Vivek Oberoi, Restrains Misuse of Identity

The Delhi High Court has extended crucial legal protection to actor and entrepreneur Vivek Oberoi by restraining the unauthorized use of his name, image, voice, and other personal attributes. This follows Oberoi’s petition addressing widespread misuse of his identity across digital platforms and commercial products. The court’s order highlights the increasing judicial awareness of personality and publicity rights amid the rise of artificial intelligence and online impersonation.

Court Proceedings and Order Highlights

In a suit filed earlier in February, Oberoi sought protection against entities exploiting his identity without consent through fake social media profiles, AI-generated or morphed visuals, and other digital content. Justice Tushar Rao Gedela underscored Oberoi’s established public persona and goodwill, affirming the need for legal safeguards.

The court’s interim injunction prohibits any unauthorized commercial or personal use of Oberoi’s identity including his name, image, voice, likeness, and signature across various technologies such as AI tools, deepfake software, and face-morphing applications.
Additionally, the court directed major online platforms like YouTube, Meta Platforms, and X Corp to remove all infringing content within 72 hours of receiving notice. It also banned the creation and sale of unauthorized merchandise, such as posters or T-shirts bearing Oberoi’s likeness, that are circulated for commercial gain.
Justice Gedela stressed that without timely intervention, Oberoi’s reputation and career could suffer irreparable damage, emphasizing that a public figure’s identity cannot be commodified without consent.

Allegations Detailed in the Lawsuit

Oberoi’s petition detailed the creation of multiple fake accounts on platforms like Instagram, misusing his name and images. Some accounts circulated deepfake or altered content deemed misleading and inappropriate. The suit also pointed to unauthorized merchandise and online listings commercially exploiting his persona without permission.

The filing described the misuse as causing “incalculable loss” to Oberoi’s goodwill and reputation, potentially misleading the public and diminishing his professional value as both an actor and entrepreneur.
